Gender Identity Discrimination
In Oregon, an employer may not discriminate or retaliate against an individual based on their Gender Identity.
In 2012, the EEOC in Macy v. Department of Justice, EEOC Appeal No. 0120120821 (April 20, 2012), held that discrimination against an individual because that person is transgender is discrimination "because of sex" and is thereby covered under Title VII of the Civil Rights Act of 1964. Moreover, it has been recognized by the courts that discrimination against an employee because they do not conform to expected sexual stereotypes is unlawful as sex discrimination.
