State and federal laws dictate minimum wage obligations, overtime requirements, and lunch and break schedules. Under most circumstances, employers are required to pay non-exempt employees at least minimum wage and overtime wages per pay period.
When employers fail to provide required breaks, fail to pay minimum wage, fail to pay overtime when earned, or fail to pay wages earned upon termination, employees may be able to recover penalties in addition to those unpaid wages, either through the state Wage & Hour agency, or through private action.
